Terms of Use — The Report

These Terms govern your use of The Report (“the app”), operated by Brainiac LLC. By creating an account or using the app you agree to these Terms. If you do not agree, do not use the app.
The service
The Report provides surf forecasts, conditions, and related information for coastal locations. Forecasts are computed predictions, not guarantees.
Safety — read this
Surf, weather, and ocean forecasts are estimates and can be wrong. Conditions change rapidly and can be dangerous. Do not rely on The Report for decisions affecting safety of life or property. Always assess conditions yourself, heed local warnings, lifeguards, and authorities, and understand your own limits. You use the app, and enter the water, entirely at your own risk. The Report is provided for informational and recreational purposes only.
Your account
You sign in with Sign in with Apple or a one-time email code. You are responsible for activity under your account and for keeping access to your email. You must be at least 13 years old to use the app.
Free trial and subscriptions
- 30-day free trial. New accounts get full access free for 30 days. No payment method is required and you are never automatically charged. When the trial ends, access to forecasts pauses until you choose to subscribe. We may offer a one-time trial extension; any such offer is discretionary and does not renew.
- Subscriptions. After the trial, continued access requires a paid subscription: $4.99 per month or $49.99 per year (prices may vary by region and are shown in the app before purchase). Subscriptions are sold as auto-renewable in-app purchases billed through your Apple ID.
- Auto-renewal. A subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. Manage or cancel anytime in your Apple ID subscription settings; we cannot cancel or refund Apple purchases on your behalf. Refunds are handled by Apple under its policies.
- Restore. You can restore an active subscription on a new device from the app’s paywall or settings.
Your content
Custom spots, logged sessions, favorites, and preferences you create are yours. You grant us a limited license to store and process them solely to provide the app to you. Custom spots are private to your account; if you share a spot link, the recipient receives their own independent copy of that spot’s settings. Do not create content that is unlawful or infringes others’ rights.
Acceptable use
Do not misuse the app: no reverse engineering except as permitted by law, no attempts to break authentication or access others’ data, no automated scraping of forecasts, and no reselling of the service.
Availability and changes
We may change, suspend, or discontinue features, data sources, or the app itself. Forecast data depends on third-party sources (e.g. NOAA, Open-Meteo, CDIP) that may be unavailable or change without notice.
Disclaimers
The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or uninterrupted availability, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, Brainiac LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or reliance on the app or its forecasts. Where liability cannot be excluded, it is limited to the amount you paid for the app in the 12 months before the claim.
Indemnification
You agree to indemnify and hold harmless Brainiac LLC and its members and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the app.
Termination
You may stop using the app and delete your account at any time (Settings → Account → Delete Account). We may suspend or terminate access for violations of these Terms.
Apple
These Terms are between you and Brainiac LLC, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support or maintenance, and, to the extent it applies, is a third-party beneficiary of these Terms with the right to enforce them. The app must be used in compliance with the Apple Media Services Terms and Conditions.
Governing law
These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-laws rules.
Changes to these Terms
We may update these Terms; the effective date reflects the latest version and material changes will be surfaced in the app. Continued use after a change means you accept it.
